Welcome to Saint Zita Softwash LLC. By accessing our website or utilizing our services, you agree to the following terms and conditions.
1. Mobile Messaging Program (SMS)
To ensure smooth communication, Saint Zita Softwash LLC offers a mobile messaging program.
- Program Name: Saint Zita Softwash Notifications.
- Description: Messages are sent to provide appointment reminders, delivery of service quotes, quote review reminders, billing invoices, and invoice reminders.
- Message Frequency: Message frequency varies based on your project status, but will not exceed 5 messages per month.
- Message and Data Rates: Message and data rates may apply.
- Opt-Out: You can cancel the SMS service at any time. Just text STOP to 737-271-8766. After you send the SMS message STOP to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
- Support: If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at 737-271-8766.
- Privacy Policy: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
2. Scope of Work
The Company will perform services as detailed in the project quote or written correspondence.
- Pressure/Soft Washing: Use of pressurized water, sodium hypochlorite and surfactants to remove organic stains. This does not guarantee removal of inorganic stains such as rust, oil, or efflorescence unless explicitly requested and stated in the project quote, whereas the Company would utilize commercial solutions such as degreasers and biodegradable chemicals.
- Window Cleaning: Use of purified water, water-fed poles, or squeegees to remove dust, dirt, and cobwebs. This does not include removal of hard water stains, oxidation, or construction debris unless specifically requested and stated in the project quote whereas the Company would utilize appropriate commercial biodegradable chemicals.
- Service Deadlines: Any deadlines for service completion are based strictly on communicated desires from the Client and agreement from the Company in writing via text or email. If not provided in writing, such deadlines or orders are not legally binding.
3. Client Responsibilities
- Water Access: The Client must provide unrestricted access to a functional on-site water supply. If access is not provided or an outside water source is required, the Company may be unable to perform services.
- Site Preparation: The Client is responsible for ensuring all areas to be serviced are clear of obstructions (furniture, planters, vehicles, etc.) to allow for safe and effective delivery.
- Property Condition: The Client shall indemnify and hold the Company harmless from liabilities arising from the Client's failure to comply with these requirements.
4. Payment Terms
- Due Date: Unless otherwise stated in writing, payment is due immediately upon the sending of the invoice.
- Tax Exemption: Tax-exempt Clients must provide necessary documentation to the Company to facilitate that status.
- Late Fees: For commercial clients, a late fee of 2% per month will accrue after a 12-day grace period for unpaid invoices. For residential clients, a late fee of 5% of the total invoice applies after said grace period.
5. Liability & Post-Service Inspection
- Insurance: The Company maintains a general liability policy of no less than $1,000,000.
- Pre-existing Damage: The Company is not liable for pre-existing damage, including but not limited to cracks, oxidation, loose paint, unsealed surfaces, or blown window seals.
- Normal Operation: The Company shall not be liable for unintended damage resulting from normal operation of equipment provided it adheres to industry standards.
- Inspection: Any concerns or damage must be reported in writing within fourteen (14) days of service completion. Failure to report within this period may limit the Company's obligation to address issues.
6. Rescheduling, Termination, & Force Majeure
- Rescheduling: The Company reserves the right to reschedule services with short notice due to adverse weather conditions, equipment difficulties, or site conditions that do not meet the requirements outlined above
- Force Majeure: The Company shall not be liable for delays or failure to perform due to events beyond its control, including but not limited to acts of God, natural disasters, power failures, or government restrictions.
- Cancellation: Either party may terminate this agreement with 48 hours' notice before services are delivered.
7. Acceptance and Binding Agreement
By electronically authorizing the commencement of work, the Client hereby acknowledges that they have read, understood, and voluntarily consented to be bound by the entirety of these Terms and Conditions. This Agreement constitutes a legally binding contract between the Client and SAINT ZITA SOFTWASH LLC. The Client's execution of the estimate serves as an express affirmation that all project specifications, including scope of work, pricing, and the limitations of liability outlined herein, are accepted in full. No oral representations or unsigned requests shall be deemed to modify this Agreement unless documented in writing via text or email.
